On October 1, 2018 the state of New York passed the Raise the Age (RTA) Act, which raised the minimum age for criminal responsibility for nearly all crimes to 18. The RTA also created new, or altered existing, offender categories: Juvenile Delinquent (JD), Youthful Offender (YO), and Adolescent Offender (AO). Under the RTA, a Juvenile Delinquent is a minor between the age of 7-18 who has committed an offense that would be considered a crime if committed by an adult, minors aged 16 & 17 who commit a misdemeanor (except for traffic law violations, in which case they are treated as adults) are tried as a JD, JD's are tried in Family Court and are not sent to jail, instead the court decides if they need supervision, treatment or placement through the local department of social services, and JD's do not have a criminal record; minors under the age of 13 are not charged with misdemeanors, and minors under 7 aren't charged with felonies. The RTA changed the definition of Juvenile Offender (JO) to a minor aged 13, 14, or 15 who commits a serious violent felony including murder in the second degree, any first degree violent felony sex offense, first degree arson, first degree kidnapping, and first & second degree robbery; JO's are tried in the Youth Part of the Supreme Court or County Court and receive less severe sentences than adults, and have a criminal record, unless the judge grants them a YO status. Youthful Offender status can be granted, at a judge's discretion, to minors between 14-19 who have no prior felony convictions, and have never been granted YO status before; a minor convicted as a YO has their record sealed, causing them to not have a criminal record. Finally, Adolescent Offenders are minors aged 16 or 17 that commit a felony; if the crime is a non-violent felony the judge will remand the case to Family Court where they will be tried as a JD, unless the District Attorney files a request for them to be tried as an AO, in which case they're tried in the Youth Part of the Supreme or County Court; if the crime is a violent felony then they will be tried as an AO and treated as an adult, meaning they will have a felony criminal record, although they will be sentenced less severely. Adults who were convicted as Juvenile Offenders or Adolescent Offenders (except for sexually motivated violent felonies), can petition the court they were convicted in to have their criminal record expunged, if they have had a clean criminal record for a minimum of 10 years after they successfully finished their jail and/or probation sentence.
